These Terms of Use (hereinafter "Terms") govern access to and use of the Yallabina (Client), Yallabina Pro (Driver) and Yallabina PoS (Point of sale) mobile applications, hereinafter collectively "the Platform", published by Yallabina SARL – RC registered with the Chamber of Commerce, headquartered in Algeria.

Yallabina is a digital intermediation platform connecting clients wishing to ship goods with independent carriers registered on the Yallabina Pro application. Yallabina is not a carrier and is not a party to the transport contract concluded between the Client and the Driver.

Use of the Platform implies full and unconditional acceptance of these Terms.
Part I – Common Provisions

These provisions apply to anyone using one of the three applications.

Article 1 – Definitions

  • "Platform": the Yallabina, Yallabina Pro and Yallabina PoS mobile applications, and all associated services.
  • "Client": any adult natural person or legal entity having created an account on the Platform to request a goods transport service.
  • "Driver": any independent carrier registered on the Yallabina Pro application, acting as an independent service provider.
  • "Ride": the transport service for one or more parcels/goods from a pickup point to a delivery point, ordered via the Platform.
  • "Yallabina Credit": virtual monetary unit usable exclusively within the Platform.
  • "Kiosk": physical point of sale authorized by Yallabina allowing the purchase of Yallabina Credit against cash payment.
  • "Commission": amount retained by Yallabina on the price of each Ride as remuneration for Platform services.

Article 2 – Access Conditions

2.1 Eligibility

Access is reserved for natural persons aged at least 18 years with full legal capacity, as well as legal entities duly constituted under Algerian law.

By registering, the Client declares being at least 18 years old, acting on their own behalf or duly authorized, and providing accurate, complete and up-to-date information.

2.2 Account Creation

Registration requires a valid phone number, first and last name, and a valid email address. The phone number constitutes the Client's unique identifier.

Any account inactive for 60 consecutive days is deactivated. The deactivated account is then kept in archive for 85 days, after which it is permanently deleted, resulting in the permanent loss of associated data, including any remaining Yallabina Credit balance. Access to the service then requires a new registration.

Account recovery after the 60 days of inactivity may be carried out exclusively by means of two verified elements: the phone number and the email address associated with the account.

Article 3 – Nature of Service and Liability

3.1 Yallabina's Role

Yallabina acts exclusively as a technical intermediary. The transport contract is concluded directly and exclusively between the Client and the Driver.

3.2 Limitation of Liability

Yallabina shall not be held liable for loss or damage to goods, delays, acts of the Driver, technical interruptions, or any direct or indirect damage resulting from use of the Platform.

💡 Clients are strongly encouraged to take out appropriate cargo insurance for valuable shipments.
Part II – The Client

These provisions apply to the Client registered on the Yallabina application.

Article 4 – Ordering a Ride

4.1 Order Process

To order a Ride, the Client specifies the pickup and delivery points, confirms the payment method and validates the ride. The Ride is engaged when a Driver accepts it. It actually starts when the Client confirms the pickup of their goods by the Driver.

4.2 Pricing

The fare is calculated automatically based on the distance and the load capacity of the vehicle. Yallabina reserves the right to modify its pricing at any time. The applicable fare is that displayed at the time of order validation, which constitutes the firm and final price of the Ride.

4.3 Prohibited Goods

The following are prohibited: illicit substances, weapons, explosives, alcoholic beverages without authorization, undeclared cash, and any goods whose transport is prohibited by Algerian law. Any violation results in immediate account suspension and reporting to authorities.

Article 5 – Payment

5.1 Payment Methods

The Client may pay for Rides in cash directly to the Driver, or via Yallabina Credit automatically debited.*

5.2 Yallabina Credit

Yallabina Credit is a virtual currency specific to the Platform, with no legal value and not convertible into fiat currency. The Client acquires it by payment with a CIB or Edahabia card.

⚠️ Yallabina Credit is neither refundable in cash nor exchangeable outside the Platform. In the event of account closure, the remaining balance is permanently lost.
💰 Yallabina's commission is deducted from the Driver's remuneration (Part III, Article 10). It does not constitute an additional cost for the Client: the fare displayed before validation is the final amount due.

Article 6 – Ride Cancellation

6.1 Cancellation by Client

The Client may cancel before a Driver accepts, free of charge. After acceptance, cancellation is possible until goods pickup confirmation. Once pickup is confirmed, a 15-second cancellation window is granted. After this period, cancellation is no longer possible.

6.2 Cancellation by Driver

No fee is charged to the Client. The Platform offers to find another Driver or cancel the Ride.

Article 7 – Client Obligations

  • Provide accurate information when ordering;
  • Be present or represented at pickup;
  • Not ship prohibited goods;
  • Treat Drivers with respect;
  • Not use the Platform for fraudulent or illegal purposes.
Part III – The Driver

These provisions apply to the Driver registered on the Yallabina Pro application.

Article 8 – Status and Registration

The Driver is an independent carrier. He or she is neither an employee nor an agent of Yallabina, and remains solely responsible for their activity, vehicle, insurance, tax and social obligations, and compliance with the regulations applicable to the transport of goods.

Registration requires an application file including, in particular, the driving licence, the vehicle registration document, the insurance certificate, photographs of the vehicle and an identity photograph of the Driver.

⏳ The Driver's account only becomes usable once the file has been reviewed and approved by Yallabina. Until approval is granted, access to Rides remains closed. Yallabina may reject a file without having to justify its decision.

Article 9 – Documents and Validity

The Driver undertakes to keep their documents valid and up to date. The expiry of a document, in particular the vehicle insurance, results in the suspension of access to Rides until the situation is regularised.

Yallabina reserves the right to require any Driver to present the originals of the documents in their file, in paper form, in order to verify their authenticity, as well as to provide photocopies of those documents for archiving at Yallabina's offices. The Driver is informed by notification, by email or by telephone, and has the period indicated to them to comply. Failing presentation within that period, or if the originals do not match the documents submitted at registration, access to Rides may be suspended until the situation is regularised.

Article 10 – Remuneration, Commission and Credit

Yallabina collects a commission on the remuneration of each completed Ride. The Driver holds a Yallabina Credit balance against which this commission is charged, together with an authorised overdraft whose amount is set by Yallabina.

The Driver acquires Yallabina Credit from an authorised Kiosk, against cash payment. They may also transfer Credit to another Driver from the application. Such transfers are capped and prohibited during an ongoing Ride.

Article 11 – Location Tracking During a Ride

From the moment the Driver accepts a Ride until it is closed, the application transmits their position continuously, in order to display their progress to the Client, calculate the remaining route and keep a record of the journey.

📍 This tracking continues while the application is minimised in the background or the screen is off, and a permanent notification informs the Driver throughout its duration. It does not continue when the application is closed. It starts only upon an explicit action by the Driver — accepting a Ride — and stops automatically when the Ride ends or is cancelled.

Article 12 – Cancellations and Rating

Any cancellation by the Driver after accepting a Ride gives rise to an administrative report. Beyond three cancellations in the same calendar month, a threshold report is automatically generated.

The Driver is rated by Clients. A trust score is calculated from their average rating and their non-cancellation rate; it affects the allocation of Rides.

Article 13 – Suspension and Account Deletion

The account may be suspended in the event of expired documents, inappropriate behaviour reported by Clients, excessive cancellations, established fraud, or failure to comply with these Terms.

The Driver may delete their account from the application. Deletion follows the same regime as that provided for in Article 2.2: archiving for 85 days, then permanent deletion.

Part IV – The Point of Sale

These provisions apply to the merchant registered on the Yallabina PoS application.

Article 14 – The Point of Sale

The Kiosk, or Point of sale, is a merchant approved by Yallabina and registered on the Yallabina PoS application, who distributes Yallabina Credit to Drivers against cash payment.

Registration requires an application file including the merchant's identity documents, the business documents and the location of the business, indicated on a map. The account only becomes usable once approved by Yallabina.

The Point of sale only issues Credit once the corresponding payment has actually been collected. Its activity is monitored by Yallabina. The account may be suspended in the event of activities deemed fraudulent or suspicious.

Part V – Final Provisions

These provisions apply to anyone using one of the three applications.

Article 15 – Intellectual Property

All Platform elements (logo, interface, algorithms, content) are the exclusive property of Yallabina SARL and are protected by Algerian law. Any unauthorized reproduction or use is strictly prohibited.

Article 16 – Amendment of Terms

Yallabina reserves the right to modify these Terms at any time. In case of substantial modification, you will be informed by notification or email, with a minimum notice of 3 days. Continued use of the Platform after this period constitutes acceptance of the new Terms.

Article 17 – Complaints

Any dispute relating to a Ride or to the operation of the Platform is raised by means of a complaint opened from the application, in the assistance section. It may be attached to a specific Ride or concern the account itself.

A complaint gives rise to a written exchange with Yallabina's customer service within the application, until it is closed. Yallabina examines it in the light of the elements available to it, in particular the Ride history and the recorded route.

The parties undertake to seek an amicable solution through this channel before any legal action.

Article 18 – Governing Law and Jurisdiction

These Terms are governed by Algerian law. In the event of a dispute, the parties undertake to seek an amicable solution. Failing that, the competent Algerian courts shall have sole jurisdiction.

This Privacy Policy describes how Yallabina SARL collects, uses and protects your personal data in connection with the use of the Yallabina mobile application, in accordance with Algerian law No. 18-07 of 10 June 2018 relating to the protection of natural persons in the processing of personal data.

Article 1 – Data Controller

Yallabina SARL, RC registered with the Algerian Chamber of Commerce, is the controller of your personal data.

Article 2 – Data Collected

2.1 Identification Data

  • First and last name;
  • Phone number (unique identifier);
  • Email address;
  • Profile photo (optional).

2.2 Geolocation and Technical Data

Your GPS location is collected during active use of the application to identify the pickup point, calculate the route and track delivery in real time.

Technical data related to your device (IP address, identifier, operating system) is collected by Google Firebase. Yallabina does not have access to your IP address: Google uses it to infer a country or city, then does not retain it. Yallabina does, however, have access to aggregated usage statistics (number of openings, sessions, countries, device types), which do not allow you to be identified individually.

2.3 Transaction Data

  • Amount and details of completed Rides;
  • Yallabina Credit movement history;
  • Payment method used.

2.4 Data Specific to Drivers

In addition to the data above, the Driver registered on Yallabina Pro provides the documents of their application file: driving licence, vehicle registration document, insurance certificate, photographs of the vehicle, identity photograph and registration number. These documents are retained throughout the duration of their activity on the Platform.

Their position is recorded continuously during the Rides they accept, under the conditions described in Article 5.

2.5 Data Specific to Points of Sale

The merchant registered on Yallabina PoS provides their identity documents, the documents of their business, a photograph of themselves taken in the application at registration, and the location of their business. The Credit sale transactions they carry out are recorded.

2.6 Ratings and Preferences

At the end of each Ride, the Client and the Driver may rate each other. The resulting average rating is kept in each party's file.

The language selected in the application is also recorded, so that the notifications and messages addressed to you are sent in that language.

Article 3 – Processing Purposes

  • Account management and service provision;
  • Connecting with Drivers and real-time Ride tracking;
  • Fare calculation and payment processing;
  • Customer service and dispute management;
  • Platform improvement;
  • Sending Ride-related notifications;
  • Fraud prevention and combating illicit activities;
  • Compliance with our legal obligations.

Article 4 – Legal Basis

  • Contract performance: provision of requested services;
  • Consent: collection of geolocation data;
  • Legitimate interest: service improvement and fraud prevention;
  • Legal obligation: compliance with Algerian regulations.

Article 5 – Geolocation

Collecting your location is necessary for Platform operation. It allows identification of your pickup point, route and fare calculation, and real-time Driver tracking.

📍 Client: your location is only collected during active use of the application, with the screen on. It is never collected in the background.
🚚 Driver: from the moment a Ride is accepted until it is closed, the position is transmitted continuously, including while the application is minimised in the background or the screen is off, and a permanent notification signals this. Transmission stops at the end of the Ride, and does not continue when the application is closed. Outside Rides, no position is transmitted.
🏪 Point of Sale: the location is used only once, during registration, to record the location of the business — which the merchant selects themselves on a map. It is not read, transmitted or tracked thereafter.

Article 6 – Data Sharing

6.1 Sharing with Drivers and Points of Sale

Your first name, last name initial, phone number and pickup/delivery addresses are shared with the assigned Driver, strictly for Ride execution.

When a Driver buys Credit from a Point of Sale, the Driver's first name is shown to the merchant, so that the Credit is handed to the right person. No other Driver data is disclosed to them.

6.2 Technical Providers – Firebase and Google

Yallabina uses Firebase (Google LLC) to host its data. This involves a transfer to servers located outside Algeria, governed by Google LLC's contractual terms.

6.3 Legal Authorities

Yallabina may communicate your data to competent Algerian judicial authorities upon request or legal obligation.

6.4 No Sale of Data

✅ Yallabina will not sell, rent or transfer your personal data to third parties in any way.

Article 7 – Retention Period

  • Account data: for the duration of your registration, then 85 days after closure, after which it is permanently erased;
  • Transaction data: for the period necessary to comply with our legal obligations;
  • Geolocation data: the journey travelled during a Ride — as well as, in the event of cancellation, the short verification period that follows it — is recorded and retained with the Ride file, so that it can be reconstructed in the event of a dispute and to allow fraud detection. No position is recorded outside this scope.
  • Driver file documents kept on paper: photocopies provided at Yallabina's request (Part III, Article 9 of the Terms) are archived at its offices for the duration of the Driver's registration, then destroyed.
  • Point of Sale file documents: the identity documents, business documents and photograph provided at registration are retained for the entire duration of the business's registration on the Platform, then erased.

Article 8 – Data Security

  • Encryption of data in transit (HTTPS/TLS);
  • Secure authentication via Firebase Authentication;
  • Strict access controls within the organization;
  • Firestore security rules limiting data access to their legitimate owners.

Article 9 – Your Rights

In accordance with Algerian law No. 18-07 of 10 June 2018, you have the following rights:

  • Right of access: download a copy of your personal data from your profile;
  • Right of rectification: modify your personal information from your profile;
  • Right of erasure: delete your account and data from your profile.
🏪 Point of Sale: the Yallabina PoS application does not yet offer these actions in the merchant's profile. The merchant exercises their rights through the request form, reachable from their profile in the application, or by e-mail at contact@yallabina.app.

Deleting an account results in its archiving for 85 days, after which the data is permanently erased.

Article 10 – Cookies

The Yallabina application does not use cookies. Technical session identifiers may be used by Firebase to ensure authentication.

The application uses the audience measurement tool Google Analytics for Firebase, which relies on a technical device identifier, including the Android advertising identifier, for statistical purposes only: number of openings, sessions, retention, countries, device types. This data is used neither for advertising nor for profiling purposes, and is not transferred to any third party for such purposes.

Article 11 – Minors

The Platform is exclusively reserved for persons aged 18 or over. Any account created by a minor will be immediately deleted.

Article 12 – International Transfers

Use of Firebase involves a transfer of data to servers located outside Algeria, governed by Google LLC's contractual guarantees. By accepting these terms, you consent to this transfer.

Article 13 – Policy Amendment

Yallabina reserves the right to modify this Policy at any time. In case of substantial modification, you will be informed by notification or email, with a minimum notice of 3 days.

Article 14 – Governing Law

This Policy is governed by Algerian law, in particular law No. 18-07 of 10 June 2018. The competent Algerian courts shall have sole jurisdiction over any dispute.
